Rental Waiver of Liability *

I acknowledge and understand that participation in kayaking, paddle boarding, jet skiing, and any related water activities involves significant and inherent risks, both known and unknown. These risks include, but are not limited to: collisions, falls, bodily injury (including to the spine, limbs, and head), pinching, drowning, permanent disability, and death. Such risks may arise from my own actions or inactions, the actions or negligence of others, equipment failure, weather and water conditions, and other unforeseeable factors, including acts of God. I assume all risks associated with rental activities, including but not limited to the risks of personal injury, property damage, and death.

I voluntarily assume full responsibility for any and all risks associated with these activities, whether caused by negligence or otherwise, and I agree to inform all members of my party about these risks prior to their participation. I further agree to assume responsibility for their actions and safety.

RELEASE OF LIABILITY *

I hereby release, discharge, and hold harmless Lake View Watersports Inc., including its owners, employees, agents, contractors, successors, heirs and representatives from any and all claims, actions, or losses for personal injury (physical and mental), property damage, wrongful death, or other loss that may arise out of my use of the rental equipments including travel to and from any location at which these activities occur. This release applies to any negligence, act, or omission by Lake View Watersports Inc., including its owners, employees, agents, or representatives.

I agree that I will not sue or make a claim against Lake View Watersports Inc., including its owners, employees, agents, or representatives for damages or injuries caused by the negligence, breach of contract, or breach of any statuary or other duty of care, which include any duty of care owed under the OCCUPIERS’ LIABILITY ACT, R.S.O. 1990, c. O.2, or other faults of the “released parties”. If I and/or my child/ward are injured, I acknowledge that I and/or my child/ward may require medical assistance, which I acknowledge will be at my own expense or the expense of my personal Insurer(s). I hereby represent/affirm that I have adequate insurance to provide coverage for such medical expenses. I understand and agree that Lake View Watersports Inc., including its owners, employees, contractors, successors, heirs agents, or representatives will not pay for any cost or expenses incurred by me if I and/or my child/ward are injured.

RESPONSIBILITY FOR PROPERTY *

I understand that I am responsible for the proper care and safe operation of the rental equipment during the rental period. I agree to return the rental equipment in the same condition in which it was received. I am responsible for checking all the dents, marks, and damage, and taking pictures before taking the rental equipment out on the water.

VERY IMPORTANT RIDING RULES *

1- Do not pick up passengers from any dock. Board the watercraft from the water this will eliminate any damage

2- You are now the operator of a Jet Ski, always look in all directions for other boats before turning. Keep a distance of at least 500 feet from all boats and shorelines and the waterpark.

3- Do not splash, approach, or cross the path of any other watercraft in your group or on the lake.

4- Always wear a PFD and securely attach the lanyard/Key. PFDs, fuel, anchor and safety equipment are included with the rental price.

5- If the lanyard/Seadoo’s Key is lost, a 30.00/100.00 cost will be taken from the deposit.

6- Turns cannot be made without applying throttle.

7- If you should capsize the watercraft upright it as soon as possible.

8- There are no brakes on a personal watercraft; the stopping distance is approx. 300 feet from full speed; therefore, stay away from other riders.

9- Don't jump boat wakes or cross the paths of boats and watercraft.

10- There will be an overage charge of up to 30.00 dollars per 10 minutes if you are late and go over your time limit.

11- You must obey the no-wake zones between the rental site and the riding area. Go slow on your way out to the lake. Your time will not start until you reach the riding area. I understand that I am not to leave the designated riding area because of water hazards and safety.

12- If any of the above rules are broken Lake View Watersports Inc. Has the right to withhold the deposit required to rent the personal watercraft.

13- Do not sink the watercraft. If this does happen, do not start it with water in the motor. This will create excessive damage.

14- All persons in my party & I have not consumed alcohol or Narcotics prior to this activity and will not participate in this activity while renting from Lake View Watersports Inc.

ACKNOWLEDGMENT OF RULES *

I have carefully read and understand the above rental instructions,  rental policy, and fully understand that I could lose the rental deposit (plus damages) for disobeying any of the above rules. If there is an accident (equipment damage) the estimated charges will be placed immediately on the credit card or from the deposit. I also understand that I could receive a fine if any of the rules are broken or careless driving activities occur.
